The organizer of this competition is Innovative Sensor Technology IST AG, Stegrütistrasse 14, 9642 Ebnat-Kappel, Switzerland.
Participation in the competition is free of charge. Participation is done by registering for the IST AG newsletter and confirming the subscription. By participating, participants automatically confirm the conditions of participation.
2. Participation data
Please note that you must provide your personal details when entering and that a double opt-in must be carried out. The data required for the implementation and processing of the competition will be collected and stored by us in accordance with the statutory provisions. For details, please refer to the data protection provisions (section 15).
By participating, you confirm that no copyright or personal rights are infringed. Registration alone does not entitle you to publication. Multiple participation is prohibited.
3. Persons entitled to participate
All persons who have participated in Sensor+Test 2023 in Nuremberg at the time of their participation are entitled to participate. Employees, authorized representatives, legal successors and agents of the organizer as well as all advertising agencies and event companies involved in the event and the implementation of the competition and their respective family and household members are excluded from participation.
4. Further conditions of participation
The prerequisite for effective participation in the prize draw is the provision of the necessary participation data (cf. Section 2) in the electronic registration form. Please note that only participants from whom complete data records are available will be entered into the prize draw. Participation in the prize draw is not dependent on the purchase of goods, the use of services against payment and/or the payment of connection fees and/or user fees to the organizer or to other companies involved in the organization of the prize draw.
5. Multiple entries, false statements
Participation in the competition is only possible in one's own name. Participation via straw men is not permitted. Each participant may only enter once. Multiple entries will result in exclusion from the competition. The same applies to the entry of false or foreign data (name, address, e-mail address). The (possible prize claims) are not transferable before payment.
6. Closing date / prize determination
The closing date for entries is listed in the competition. Entries received after this date will not be entered into the draw.
7. Prize distribution
Winners will be notified by e-mail, post or telephone. Any statutory tax levies will be deducted. The non-cash prizes will be sent to the address provided during registration. It is not possible to convert non-cash prizes into a cash payment. The winners themselves are responsible for the payment of any taxes that may be incurred.
8. Announcement of the winners
The winners will be published in the summer newsletter of IST AG. By participating in this contest, the participant allows IST AG, in case the participant wins, to publish his/her abbreviated name and city on the contest page.
9. Exclusion from participation
The organizer reserves the right to exclude further persons from participation in addition to the group of persons mentioned in item 2, provided that an exclusion is objectively justified. An objective reason exists in particular if it becomes apparent that a participant violates the prohibition of multiple participation in Clause 5 or violates the conditions of participation in any other way. Persons who obstruct or disrupt the proper conduct of the competition, e.g. by manipulating or attempting to manipulate the entry process, the game and/or the pages and/or violating the rules of the game and/or otherwise attempting to influence the competition in an unfair and/or dishonest manner, in particular by disrupting, threatening, harassing employees/software of the organizer or other participants, may also be excluded from participation. Further sanctions and measures (damages, criminal charges) are expressly reserved in this respect.
10. Forfeiture of the right to the prize
If it is not possible to distribute a prize to a winner determined in the draw because notification of the prize and/or delivery of the prize fail and cannot be made good within one month of the draw, the claim to the prize shall be forfeited. The claim to the prize shall also be forfeited if the determined winner refuses to accept the prize.
The same shall apply if it only becomes apparent after the draw that a winner was excluded from participation or that the conditions for exclusion pursuant to Clause 10 exist or existed.
11. Measures in the event of disruptions to the prize draw process
The organizer reserves the right to modify, cancel or terminate the prize draw for factual reasons at any time without prior notice. An objective reason exists in particular if the raffle cannot (or can no longer) run as planned (e.g. in the event of infection of computers with viruses, software or hardware errors or for other technical, factual or legal reasons that impede the administration, security, integrity or the regular and orderly execution of the sweepstakes. The organizer shall decide in its reasonable discretion whether the sweepstakes can be continued in a modified form or whether an interruption or early termination is warranted.
12. Legal action and liability
No correspondence will be entered into about the competition. The legal process is excluded. There is no enforceable claim to the payment of the winnings.
Data communication via the Internet cannot be guaranteed to be always error-free and available according to the current state of technology. The organizer is therefore not liable for the constant and uninterrupted availability of the online systems used by him, nor for technical and electronic errors of a telemedia service over which he has no control, not for disruptions such as the loss, delay, alteration, manipulation or misdirection of e-mails, which have their cause in external data networks, external telephone lines or other hardware or software of the participants or third parties. The same applies to malfunctions about the entry, recording, transmission and storage of data, in particular also for faulty, missing, interrupted, deleted or defective data records.
Furthermore, no liability shall be assumed if e-mails or data entries (in masks of the competition pages) do not comply with the requirements set out therein and are consequently not accepted or accepted by the system. The organizer is also not liable for theft or destruction of the systems or storage media storing the data. The same applies in case of unauthorized modification or manipulation of the data by the participants or third parties.
The organizer shall only be liable for damages other than those resulting from injury to life, body, or health insofar as these are based on intentional or grossly negligent actions on the part of the organizer or its vicarious agents. In the event of a culpable breach of an essential contractual obligation, the organizer shall also be liable for negligent breaches of duty. Essential contractual obligations are those that make the execution of the contract possible in the first place and on whose compliance the participant may regularly rely. 14. Data protection
IST AG may use your personal data for market research and marketing purposes. Your data will not be passed on to third parties for their own advertising purposes. An exception is made if the shipment of the material prizes takes place directly via the competition partner / sponsor. In the context of the implementation of the contest, the sponsor may use your personal data solely for the purpose of awarding prizes.
15. Final provisions
Should any provision of the terms and conditions of participation be or become invalid, this shall not affect the validity of the remaining provisions. The competition is exclusively subject to Swiss law. The place of jurisdiction is St. Gallen.
